

On June 28, 2024, the Journal of Autonomy Studies (Vol. 100 No. 7) published a paper titled “Gender-Sensitive Interpretation in Light of International Treaties for the EU Asylum Requirements Directive” by Professor Yumiko Nakanishi of the Graduate School of Law. In this paper, Professor Nakanishi focuses on the need for a gender-sensitive perspective given that the EU Asylum Requirements Directive is based on the Refugee Convention, and discusses how it should be interpreted in light of the Convention on the Elimination of All Forms of Discrimination against Women, the Istanbul Convention on the Prevention of Violence against Women and Domestic Violence, and the United Nations High Commissioner for Refugees (UNHCR) Guidelines. Professor Nakanishi first explained the case summary of Case C-621/21 and then explained the significance of this case. Regarding this decision, Professor Nakanishi pointed out that it can be seen as a decision that protects women from domestic violence and sexual violence. In other words, she expressed the opinion that the EU Court of Justice has indicated its policy of actively incorporating a gender perspective into EU asylum law. In particular, Professor Nakanishi emphasizes that the Court has demonstrated its stance to strengthen the protection of women through gender-sensitive interpretation, actively using international documents related to women’s rights, such as the Convention on the Elimination of All Forms of Discrimination against Women, the Istanbul Convention and the UNHCR Guidelines.
