In December 2023, a book titled Global Impact of the Ukraine Conflict: Perspectives from International Law, which has a chapter titled “Ukraine Situation and Its Relationship to the Principle of Complementarity” co-authored by Professor Hitomi Takemura of the Graduate School of Law, was published from Springer. This book aims to provide a comprehensive answer to the extent to which, and in what ways, the Ukraine conflict may impact the legal framework of the international community and the rules of international law. Professor Takemura highlights that the armed conflict between Ukraine and Russia has resulted in war crimes and alleged acts of aggression by Russia which, like many armed conflicts, have drawn attention to the complementary relationship between domestic courts and the International Criminal Court (ICC). She explains that the Ukrainian situation is referred to as complementarity in practice or positive complementarity in practice and is known as a case in which the principle of complementarity is actually at work. Moreover, she emphasizes that the situation in Ukraine is an important aspect of the principle of complementarity and the functioning of the ICC’s organization, ensuring its impartiality and independence, and its state parties need to carefully oversee the ICC’s steering so that the situation in Ukraine does not undermine the legitimacy of the ICC.
